Terms of Service

By visiting gabellar.com, accessing the Gabellar demo at gabellar.com/demo, or submitting your email for beta waitlist access, you agree to these Terms in full. If you do not agree to these Terms, you must not use the site or the demo.

These Terms constitute a binding agreement between you and Gabellar (the founding team operating the Gabellar project). Gabellar is not yet a registered legal entity at the time these Terms were written. These Terms remain valid and enforceable to the fullest extent permitted by applicable law notwithstanding that status.

Gabellar is an early-stage product currently in private beta / demonstration phase. This is pre-launch software. It is not a finished or commercially available product.

• The demo is provided for evaluation and feedback purposes only.
• The demo may contain bugs, errors, incomplete features, or unexpected behavior.
• We provide no uptime guarantees. The demo may be unavailable, altered, or taken offline at any time without notice.
• Gabellar reserves the right to modify, suspend, or discontinue Gabellar or gabellar.com — in whole or in part — at any time, for any reason, without prior notice and without liability to you.
• Beta access does not create any entitlement to continued access, future access, or any commercial service.

Gabellar uses third-party AI APIs to generate social media content based on your inputs and configurations. You acknowledge and agree that:

• You are solely responsible for reviewing all AI-generated content before publishing or distributing it anywhere.
• Gabellar makes no guarantees, representations, or warranties regarding the accuracy, legality, originality, appropriateness, or fitness for any purpose of AI-generated outputs.
• AI-generated content may be factually incorrect, misleading, offensive, or legally problematic. You must exercise your own judgment before publishing any output.
• You, not Gabellar, bear full responsibility for the consequences of publishing any content — including but not limited to defamation, copyright infringement, false advertising, and violations of platform terms of service.
• Gabellar is not responsible for how you use AI outputs, including any legal claims arising from published content.
• Third-party AI providers (such as OpenAI, Anthropic, or Google) may have their own rights and restrictions regarding AI outputs under their terms. You are responsible for complying with those terms.

By using gabellar.com or the Gabellar demo, you agree not to:

• Use the service to create, distribute, or facilitate spam, unsolicited messages, or bulk automated communications.
• Generate or publish content that is illegal, defamatory, harassing, hateful, discriminatory, or violates any applicable law or regulation.
• Impersonate any person, brand, or entity, or misrepresent your affiliation with any person or organization.
• Attempt to circumvent, disable, or interfere with security features of the site or demo.
• Reverse-engineer, decompile, or attempt to extract the source code or underlying logic of the Gabellar platform.
• Use the demo to infringe upon intellectual property rights of any third party.
• Use the site or demo in any manner that could damage, disable, overburden, or impair Gabellar's infrastructure or interfere with other users.

Gabellar reserves the right to terminate or restrict your access for violations of these rules, without notice and without liability.

Gabellar's IP: The Gabellar platform, its user interface, design, branding, trade name, and all underlying software, logic, and systems are the intellectual property of Gabellar and its founding team. Nothing in these Terms transfers any ownership rights in the platform to you.

Your Content and Inputs: You retain all rights to the content, data, and inputs you provide when using the demo. Gabellar does not claim ownership of your inputs or the outputs generated from them. You grant Gabellar a limited, non-exclusive license to process your inputs through the demo solely to provide the service during your session.

AI Outputs: Ownership of AI-generated content may be subject to limitations under applicable law and the terms of the AI provider whose API generated the output. Gabellar makes no representations about your ownership of AI outputs. You assume all responsibility for determining the legal status of any content you publish.

Feedback: If you provide feedback, suggestions, or ideas about Gabellar, you grant Gabellar an irrevocable, royalty-free, worldwide license to use that feedback for any purpose, including product development, without compensation to you.

Gabellar is designed to assist with content creation for social media platforms including but not limited to Threads (Meta), TikTok, and X (formerly Twitter). Your use of Gabellar to create or publish content on these platforms is subject to each platform's own terms of service, community guidelines, and policies.

You are solely responsible for ensuring that any content you publish using Gabellar complies with the applicable terms and policies of each platform where you post. Gabellar is not affiliated with Meta, TikTok, X Corp., or any other social media platform, and does not guarantee that content generated by Gabellar will comply with any platform's requirements.

Violations of third-party platform terms — including account suspensions, content removal, or legal action by those platforms — are entirely your responsibility.

The Gabellar demo at gabellar.com/demo is a technology demonstration only. It is not a production environment, not a commercial service, and not a platform on which you should depend for any business or professional purpose.

All data entered into or generated by the demo is stored exclusively in your browser's localStorage. This data:

• Is never transmitted to or stored on Gabellar's servers.
• May be reset, cleared, or lost at any time — including when the demo is updated, when your browser storage is cleared, or when you switch devices or browsers.
• Should not be relied upon as persistent, durable, or recoverable storage.

Do not use the demo to store sensitive, confidential, or irreplaceable information. Gabellar assumes no responsibility for any data loss arising from use of the demo environment.

Gabellar reserves the right to modify these Terms at any time. Changes will be effective upon posting the updated Terms to this page with a revised "Last updated" date. It is your responsibility to review these Terms periodically.

As Gabellar forms as a legal entity, expands its product, or moves from beta to commercial operation, these Terms will be updated to reflect those changes. Material changes may also be communicated to beta waitlist members via email.

Continued use of gabellar.com or the Gabellar demo after any modification constitutes your acceptance of the updated Terms.

Gabellar has not yet registered as a legal entity in any jurisdiction. As a result, the governing law and jurisdiction for any disputes arising from these Terms cannot yet be definitively specified.

Upon incorporation, Gabellar will update these Terms to specify the applicable governing law and dispute resolution process. Until that time, you agree to resolve any dispute with Gabellar informally by contacting us at contact@gabellar.com before initiating any formal legal proceeding.

You acknowledge that, given Gabellar's current pre-entity status, any attempt to bring formal legal action may be limited in its practical effect, and you expressly accept this as part of your decision to use a pre-launch, no-fee demonstration product.
